BILL NUMBER:A10150
Title of bill
An act to amend the public health law and the business corporation law, in relation to limited service medical practices
Purpose
To allow corporations to operate limited service medical practices which employ licensed health practitioners to treat a limited range of medical conditions and provide diagnostic or preventative services,
Summary of provisions
Section one amends the public health law by adding a new section 2823 which provides that in a limited service medical practice, licensed health practitioners may only treat a limited range of medical conditions and provide diagnostic and preventative health care services. This section also enables the commissioner to promulgate regulations to address matters- pertinent to the operation of limited services medical practice. In addition, it requires that health practitioners who provide treatment. in a limited service medical practice report the services to the patient's primary care practitioner, if applicable, and provide the patient with information regarding the importance of having a primary care practitioner.
Section two amends section 201 of the business corporation, law by adding a new paragraph (f) which authorizes corporations to operate a limited service medical practice that employs licensed health practitioners to treat a limited range of medical conditions and provides diagnostic and preventative health care services.
Section three provides the effective date.
Justification
Allowing corporations, such as retail drugstores, to operate limited service medical practices will increase access to care for easily treatable conditions, as well as preventative and diagnostic services. The convenience of having these services available in such settings may encourage people to seek medical attention or preventative services that they would otherwise forego, and could lead to the discovery of more serious medical conditions requiring treatment.
