BILL NUMBER:A10219A
Title of bill
An act to amend the insurance law, in relation to insur- ance coverage for drugs used in cancer treatment
Purpose
To update the established reference compendia which are used as authoritative sources for use in the determination of off-label drugs and biologicals used in an anti-cancer chemotherapeutic regimen.
Description
Sections 3216, 3221, 4303 and 4900 of the Insurance Law are amended to update the listed standard reference compendia and to allow for future updates to be made without the need for special legis- lation.
Statement in support
A uniform policy for the reimbursement of drugs utilized in the treatment of cancer was originally established in New York in 1990. Included in this policy was a listing of standard refer- ence compendia. Due to changes in the pharmaceutical reference industry, two out of the three statutorily-named compendia are no longer published. In 2008 the Centers for Medicare & Medicaid Services (CMS) revised and updated their list of accepted compendia, removing the two compendia which were no longer published (the American Medical Associ- ation Drug Evaluations and the United States Pharmacopoeia-Drag Informa- tion) and adding three additional compendia (NCCN Drugs and Biologics Compendium, Thomson Micrornedex DrugDex, and Elsevier Gold Standard's Clinical Pharmacology).
It is imperative that the laws of New York keep up with the pace of innovation and clinical discovery to allow beneficiaries timely access to the most appropriate treatment options in their battle against cancer. These well established reference compendia help physicians in their ability to access cutting-edge cancer treatments for their patients.
