BILL NUMBER:A10227
Title of bill
An act to amend the education law, in relation to hepa- titis vaccinations for school district employees
Purpose or general idea of bill
To direct commissioner of education to establish a statewide program requiring school districts to make hepati- tis A, B and C vaccinations available to employees
Summary of specific provisions
Section 205 of the education law is amended by adding a new subdivision 35 to read as follows: The commis- sioner is authorized and directed to establish a statewide program requiring all school districts in the state to make hepatitis A, B and C vaccinations available to school districts at no cost to such employees.
Justification
School district employees are routinely at risk of expo- sure to Hepatitis A, B and C. The vast majority of employees are not routinely provided vaccinations against these forms of hepatitis. The current condition constitutes a real and serious health risk and occupa- tional hazard to school employees. This legislation would create a statewide system for state-provided hepatitis vaccinations that would be similar to the Federal occupational Safety and Health Administration regulations regarding hepatitis B vaccinations. The OSHA Standard 29 CFR 1910.1030 requires employers to provide cost-free Hepatitis B vaccina- tions to all employees of employers covered by the OSHA standards. Teachers and other school district employees, however, are not covered by the OSHA standards unless they are designated responsible for render- ing first aid or medical assistance. This degree of coverage is not sufficient given the great number of students and the nature of the workplace environment in which teachers and school district employees must perform their jobs. The public school system is an open and dynam- ic workplace that is constantly exposed to unanticipated and unknown environmental conditions. Enactment of this legislation would provide necessary health protections to school district employees.
