BILL NUMBER:A10290

Title of bill

An act to amend the workers' compensation law, in relation to the definition of employee

Purpose

To change the definition of employee so that it does not include people who are on orientation or training

Summary of provisions

This bill amends Section 1. Subdivision 4 of section 2 of the workers' compensation law to change the definition of employee to not include any person during orientation or training when such person is intending to become an independent contractor

Justification

Currently when a business contracts with an independent contractor it is common for the independent contractor to go through a short period of time for training and/or orientation. Recently, some businesses have been required to pay workers' compensation benefits because independent contractors were considered "employees" during the training and/or orientation period.

This bill would amend the law to clarify that independent contractors are not "employees" during the training and/or orientation period. Therefore, businesses would not be required to pay for workers' compen- sation on behalf of the independent contractors.
