BILL NUMBER:A10308
Title of bill
An act to amend the education law, in relation to contracts for excellence
Purpose or general idea of bill
Clarify that Foundation Aid must first be expended to correct those problems that caused the districts to be identified; and only to the extent necessary to correct those problems. Allow districts with contracts for excellence to reduce the amount of contract expenditures when their foundation aid is frozen or reduced. Authorize the New York State Comptroller to provide the audit certif- ication required under the contract for excellence.
Summary of specific provisions
Section 1. Clarify that Foundation Aid must first be expended to correct those problems that caused the districts to be identified and only to the extent necessary to correct those problems.
Section 2. Allow districts with contracts for excellence to reduce amount of contract expenditures when their foundation aid is frozen or reduced.
Section 3. Authorize the New York State Comptroller to provide the audit certification required under the contract for excellence.
Justification
Under current law, when Foundation Aid is frozen or reduced, districts with contracts for excellence (C4E) will be required nevertheless to fund existing contracts despite the fact that costs under those contracts will increase and state aid to support the contracts may decrease. This bill would allow districts to reduce contract expenditures by a percentage equal to any reduction in overall state education aid plus 4%. This will prevent districts from having to cut other non-contract programs to compensate for increased costs in C4E programs and lost state aid, Current law requires that all Foundation Aid be used under a contract for excellence as provided under section 211-d even though the problem which caused the district to be identified may be remedied less expensively. This bill would limit expenditures under the contract to those necessary to correct the problems, i.e. return the district to a non-identified status. Current law requires districts outside New York City to retain a private auditor to provide the certifications of compliance under section 211-d. This bill would authorize the New York State Comptroller to provide those certifications just as the NYC Comptroller already may do for NYC.
