BILL NUMBER:A10317
Title of bill
An act to amend the education law, in relation to exempting the New York state teachers' retirement system and the New York state employees' retirement system contributions, health insurance and capital equipment expenditures from items used to determine total spending under a contingency school budget
Purpose or general idea of bill
To amend the education law, in relation to exempting expenditures for contributions to the New York State teach- ers' retirement system, the New York State employees' retirement system, and expenditures for health insurance and capital equipment from items used to determine total spending under a contingency school budget
Summary of specific provisions
Section 1. This legislation would amend paragraph b of subdivision 4 of section 2023 of the education law by adding a new Subparagraph (ix) thereto which exempts expenditures for contributions to the New York State teachers' retirement system, the New York state employees' retirement system, and expenditures for health insurance and capital equipment made by school districts from the list of expenditures used in determining total spending under a contingency school budget.
Justification
When a school district's budget proposal is not approved by the voters, the sole trustee, board of trustees, or board of educa- tion must adopt a contingency budget. These contingency budgets, by law, cannot exceed the lower of either 120% of the CPI or a 4% increase in total spending over the district's total spending within the budget of the previous year. Under existing law, such payments as addressed by this bill made by school districts are included in the calculation to determine total spending under a contingency school budget. The school district is without control over these expenditures and these payments could far exceed the contingency budget cap on increases from the previ- ous year's spending for which a school district can levy a tax for a contingency budget. The school district could therefore find itself in a situation where it must cut essential programs or lay off teachers and other staff in order to pay for these expenses.
