BILL NUMBER:A10318

Title of bill

An act to amend the education law, in relation to remov- ing the salary cap on district superintendents of BOCES

Purpose or general idea of bill

To allow boards of education of BOCES districts to lift the cap on BOCES superintendents' salaries provid- ed.that they elect to forego the state portion used to supplement such salaries.

Summary of specific provisions

Section one adds language to Section 1950, subdivision 4, paragraph a, subparagraph 2 of the Education law to allow boards of education of BOCES districts to lift the salary cap on BOCES superintendents if they agree to forego the state portion-used to supplement such salaries.

Justification

A BOCES board appoints its own chief executive officer, contingent upon approval of the commissioner of education. As a BOCES executive, the district superintendent serves local districts and is responsible to the board of education representing the component. districts of the BOCES. There are currently 37 BOCES districts across New York State.

The restrictions on BOCES superintendents' compensation packages have limited the number of qualified and experienced applicants for district superintendent positions while making it difficult for BOCES to retain these employees. The result is that BOCES superintendents' positions remain empty across the state because the salary is not commensurate with the job responsibilities and requirements. The state Legislature capped the salary of BOCES superintendents in 1992.

This bill will allow individual BOCES districts to lift the cap on superintendents' salaries if those districts forego the state portion used to supplement such salaries and create compensation agreements using local funds.
