BILL NUMBER:A10353

Title of bill

An act to amend the penal law, the criminal procedure law, the correction law and the state finance law, in relation to commu- nity safety

Purpose or general idea of bill

To provide funds for increased police and equipment, by charging back prisoners a portion of the cost for their incarceration.

SUMMARY OF SPECIFIC PROVISIONS This legislation would amend subdivision 3 of section 60.27 of the penal law, and add a new section 50.28 which would allow for reimbursement of incarceration costs. Subdivision 1 of section 390.30 of the criminal procedure law is amended to provide for the determination of the economic status of the defendant, and a new section 400.50 has been added for determining the community reimburse- ment account of an inmate. The correction law is amended by adding a new section 116-a, which establishes a community reimbursement account. The state finance law is amended by adding a new section 91-f to establish a community safety fund.

Justification

Violent crime is on the rise everywhere, not just in our larger cities. New York City currently has a separate lottery to fund crime safety programs and increase police protection. Smaller communi- ties can not support a lottery, yet they are in need of funds for increased police and equipment. This bill would provide such funding.
