BILL NUMBER:A10499
Title of bill
An act to amend the environmental conservation law, in relation to set back requirements from wetlands and notice requirements to future owners or lessees
Purpose or general idea of bill
This bill will create a buffer zone for where builders can build near wetlands.
Summary of specific provisions
Section 24-0701 of the Environmental Conservation law is amended adding paragraph that states: All properties located within one hundred feet of the boundary of a designated wetland shall maintain a set back of ten feet from such wetland. The ten foot set back shall be required to be maintained in its natural state. Additionally, any potential new home- owners or renters of property located one hundred feet from the boundary of a wetland upon which the department of environmental conservation places restrictions of any sort must be notified in writing of such restrictions by the landowner before a deed is transferred or lease is signed.
Justification
The purpose of this bill is to provide greater protection to the integ- rity of our freshwater wetlands and to protect the consumer rights of homeowners and renters.
Freshwater wetlands help to absorb heavy rainfalls and filter out harm- ful pollutants from the environment. Recently, numerous concerns have been raised within my district regarding new development in areas imme- diately adjacent to wetlands, placing a severe strain on our infrastruc- ture especially during severe storms and noreasters. This bill will mandate a buffer zone of ten feet to be maintained in its natural state between a wetland and where development may occur.
There have also been numerous incidents in which my constituents purchase a house without notification that DEC prohibits certain activ- ities and structures within their yards. This bill requires that any potential homeowners and renters be notified in writing of any restrictions the Department of Environmental Conservation places on their property before a deed is transferred or lease is signed
