BILL NUMBER:A10506

Title of bill

An act to amend the general business law, in relation to requiring shop- ping mall department stores to post directional signs indicating the direction of travel to the nearest exit

Purpose or general idea of bill

To enable shoppers to exit a mall department store in a timely manner especially in the event of an emergency.

Summary of specific provisions

A new section 390-e is added to the general business law to read as follows: Defines "Department store" and "Shopping mall". Requires owner or lessee of any department store to post where doors, openings or passageways giving access to any means of egress not visible from all portions of such store, directional signs in conspicuous locations, indicating in red on a white background, or vice versa, the direction to travel to the nearest means of egress. The owner or operator of any department store found to be in violation of this section shall be subject to a civil penalty not to exceed seven hundred fifty dollars per violation.

Justification

Department store counters and racks are placed on the floor in order for shoppers to be able to view as much merchandise as possible. In many cases the far comers of the floor are filled with racks as to make visi- bility over them difficult. As the shopper walks around the floor view- ing the merchandise he/she can become disoriented as to how or where they entered the specific section of the department store. If a sales- person is not available to properly guide them, the shopper can become trapped in a maze of merchandise trying to find a way out. If there is an emergency, such as a fire alarm a shopper can become frightened and more confused as to how to find the nearest exit for egress to the outside or into the mall proper.
