BILL NUMBER:A10539
Title of bill
An act to amend the real property tax law, in relation to including the war on terrorism within the definition of "period of war" for purposes of the veterans alternative property tax exemption
Purpose or general idea of bill
To ascertain that reservists fighting the "war on terror" in Afghanistan and Iraq since 2001 receive the same alternative property tax exemptions as veterans who served in other armed conflicts specifically enumerated in the real property tax law.
Summary of specific provisions
Section 1 of the bill adds the hostilities known as the "war on terrorism", which commenced in 2001 and which includes the hostilities in Afghanistan and Iraq to the definition of "period of war".
The bill also amends the definition of "veteran" to include a reservist who served in active military, naval or air service during a period of war and who was released from active duty under honorable conditions, but who remains affiliated with his o her reserve unit.
Effects of present law which this bill would alter
This bill amends Section 458-a of the Real Property Tax Law.
Justification
As the "war on terror" expanded, our nation has increasing called upon the men and women in our military reserves to serve active duty in the immediate area of hostilities. These reservists are placed in harm's way and make great personal sacrifices to serve their country.
This bill would recognize the sacrifice these reservists make by granting them the same real property tax law exemptions as are currently provided to veterans who served in the active military during a period of war, those individuals who served as merchant seamen employed by the War Shipping Administration, civilians employed by the American Field Service and civilian flight crew and aviation ground support employees of Pan American Airways who served during World War II, so long as the reservist was released from active duty under honorable conditions and remains affiliated with his or her reserve unit.
