BILL NUMBER:A10549
Title of bill
An act to amend the criminal procedure law, in relation to designating certain code enforcement officers employed by the town of Southampton as peace officers
Purpose
Designates certain code enforcement officers employed by the town of Southampton as peace officers.
Summary of provisions
Section 1 adds a new subdivision 83 to include certain officers of the town of Southampton as peace officers.
Justification
The State of New York grants peace officers specific powers under its Criminal Procedure Law (CPL), including the ability to make warrantless searches and arrests, use requisite force, and issue summonses under Section 2.20 of that law.
Uniformed court officers, bay constables, and fire marshals employed by the Town of Southampton are registered as peace officers under CPL Section 2.10.
Due to the nature and frequency of its staff's respective duties, the Town of Southampton Code Enforcement Department is in need of personnel with specialized training to augment efforts to address property maintenance issues, overcrowding, noise, rental law permits, taxi licensing and inspections, truck and bus exclusions of the Town Code, all terrain vehicles, peddling, and others affecting the quality of life of town residents.
The designation of code enforcement employees as peace officers will provide additional specialized New York State certified training available only to peace officers recognized on the New York State Peace Officer Registry.
Such training will enhance the operation of the Code Enforcement Department and the effectiveness of its members in discharging their official duties.
The Town Board of the Town of Southampton supports the enactment of this legislation.
