BILL NUMBER:A10553

Title of bill

An act in relation to extending the provisions of arti- cle 4 of the real property tax law for residents in the counties of Orange, Rockland and Ulster; and providing for the repeal of such provisions upon expiration thereof

Purpose or general idea of bill

Because of the severe impact off the winter storms of February 23rd and February 25th, 2010, this legislation extends from March 1st to April 15th the deadline for real property tax exemption filings for School Tax Relief (STAR), veterans, individuals with disabilities, disabled crime victims and senior citizens.

Summary of specific provisions

Section 1: Notwithstands the March 1st filing deadline for section 425,458, 458-a, 459, 459-a, 459-b and 467 of the Real Property Tax Law, and extends the filing deadline for these real property tax exemptions to April 15th, 2010.

Section 2: The effective date of this act will be immediate and retroac- tive to March 1st, 2010. The provisions of this act shall be repealed after April 15th, 2010.

Justification

The severe impact of the winter storms of February 231-d and February 25th, 2010 resulted in the loss of power to large portions of the region covered under this legislation. Many residents were unable to comply with the statutory deadline of March 1st in order to apply for their real property tax exemptions. In other cases, residents were unable to file for their real property tax exemptions because the local government offices were without power and unable to serve their constit- uents.

Prior legislative history

None. This is a new bill.

Fiscal implications

None to the state and local governments.

Effective date

Retroactive to March 15', 2010 and will be deemed repealed after April 15th, 2010.
