BILL NUMBER:A10561
Title of bill
An act to amend the general business law, in relation to the honest use of refund and rebate forms act
Purpose or general idea of bill
This bill would provide consumers with a degree of protection when utilizing refund and rebate forms.
Summary of specific provisions
This bill adds Article 32-A to the General Business Law to create the "Honest Use of Refunds and Rebates Act". Specially, this act would add:
Section 676: Short title Section 677: Definitions. Section 67S: Display of expired manufacturer's refund and rebate forms prohibited. Section 679: Availability of manufacturer's refund or rebate forms. Section 679-a: Penalties Section 679-b: Affirmative defenses.
Justification
Refund and rebate offers have become increasingly popular methods of attracting customers into retail establishments. Many times, however, the customer finds that the refund or rebate offer has expired. It has also been the case that a store does not have available an adver- tised refund or rebate form. Enactment of the "Honest Use of Refunds and Rebates Act" would prohibit such deceptive practices and protect these consumers from misleading incentives to purchase certain products.
Many sellers currently have policies regarding refund and rebate forms. Although a great many of these policies are designed with the interests of the customers in mind, a number of retailers, albeit a minority, either do not have refund and rebate policies or employ policies which do not consider the consumer.
This bill will serve to protect the customer from deceptive, practices by retailers. At the same time, the enactment of the legislation should not cause an added burden to those retailers who already operate under an ethical refund/rebate policy.
