BILL NUMBER:A10566

Title of bill

An act to amend the education law and the state finance law, in relation to authorizing superintendents and schools to purchase certain material goods and supplies independently

Purpose

This bill attempts to authorize superintendents and schools to purchase certain material goods and supplies independently.

Summary of provisions

Amends section 305 of the education law by adding a new subdivision 42. Amends subparagraph (1) of paragraph a of subdivision 5 of section 163 of the state finance law, as added by chap- ter 83 of the laws of 1995:

Justification

The procurement process is often wasteful and ineffi- cient, forcing schools and superintendents into contracts that limit savings to individual school districts and lead to burdensome paperwork requirements. This legislation seeks to allow for greater flexibility in procurement. If a commodity is not available in-the costs, form, func- tion, and utility consistent with the needs of a state agency from a preferred vendor or centralized contract, then the state agency may procure the commodity independently or in conjunction with another state agency to save on costs.
