BILL NUMBER:A10631 REVISED 4/28/10

Title of bill

An act to amend the vehicle and traffic law, in relation to increasing fines for speeding violations when a child aged fifteen years or less is present

Purpose

Increases fines for speeding violations when a child aged fifteen years or less is present in the car.

Summary of provisions

Section 1 defines that this act shall be cited as the "Child Passenger Safety Law"

Section 2 amends the vehicle and traffic law by adding a new section, 1183 that establishes if a person exceeds the speed limit by 20 mph and has a child in the car aged fifteen or younger in the vehicle, the fine shall be doubled.

Justification

A child's life can be endangered when an adult decides to drive irresponsibly. Although law enforcement is excellent at catching the individuals who speed, there needs to be more of a deterrent, espe- cially when a child is in the car. If an individual exceeds the speed limit by 20 mph or more and has a child under the age of 15 in the car, that child is in serious danger. Doubling the fine for speeding with a child in the car will create a deterrent for people who drive recklessly on the road.
