BILL NUMBER:A10680

Title of bill

An act to amend the county law and the public officers law, in relation to prohibiting the broadcast of a 911 call

Purpose

OF THE BILL: This bill is to protect the privacy of citizens who utilize our 911 emergency systems from being broadcasted across radio, television or the internet.

Summary of provisions

Section 1 of the bill states that no person shall play the recording of a 911 call over a broadcast medium. A violation of this section shall be subject to a $5,000 fine. This section does not prohibit the reading or posting of transcripts of a recording.

Section 2 of the bill adds emergency 911 calls to the list of unwar- ranted invasion of personal property.

Section 3 relates to the effective date.

Justification

A person is often in an emotional and frantic state when calling 911. These calls are often intensely intimate, portraying the first response and reaction to terrifying emergencies. It is embarrass- ing and difficult to have the audio of that call later broadcasted on the news, over the, internet or on-the radio. The person who calls 911 should have a right to privacy that their phone call recording will not be made public.
