BILL NUMBER:A10699
Title of bill
An act to amend the executive law and the general municipal law, in relation to participation by minority group members and women with respect to city contracts
Purpose
Establishes that for Hispanic applicants for certification of minority women-owned business enterprise in New York State and Cities within New York State, they shall only be required to establish their "origin" and not their "descent."
Summary of provisions
Amends the New York State Executive Law Section 310, Section 2, 3, 9, 13, 14, and adds two new subdivisions 1-a and 1-b by providing that applicants of Hispanics seeking MWBE certification are only required to prove their origin rather than descent and consequently are only and solely required to provide copies of their own birth certificate and copies of a form of identification with a photographic image.
Existing law
Current law leaves with the State and City Directors of MWBE programs the discretion to promulgate rules and regulations for establishment of a person's origin and/or descent and accordingly Hispanic/Latino applicants are required to establish their descent as opposed to their origin which is required for other ethnic groups.
Justification
Currently, there are five (5) "group codes" or ethnic categories and concomitant ethnic definitions of those group codes for applicants seeking MWBE certification under both New York State and New York City regulations. Only the group code "Hispanic" is required to prove their descent rather than their "origin" for purposes of certification. As a consequence, prospective applicants of Hispanic origin are being required to provide proof of their parents and/or grandparents birth certificates to establish their descent while other groups are not required. This requirement, while wholly different from other group codes, is onerous and burdensome and has the affect of denying Hispanic applicants certification. Accordingly, this bill codifies in New York law to provide that a Hispanic need only prove that they are of Hispanic origin rather than of Hispanic descent. In addition, the only other proof or form of identification required is a photographic image of the applicant.
