BILL NUMBER:A10716

Title of bill

An act to amend the education law, in relation to basing the state aid to certain institutions of higher learning on the number of resident students; and to repeal section 6403 of the education law relating thereto

Purpose or general idea of bill

This bill will amend the education law in relation to basing the state aid otherwise known as Bundy Aid to certain institutions of higher learning on the number of resident students. This bill would amend the allocation of Bundy Aid to independ- ent colleges and universities, thus basing aid not on the number of students that graduate but on the number of students who are New York State resident graduates.

Summary of specific provisions

* Section 1: opening paragraph of paragraph (b) of subdivision 2 and subdivision 3 of section 6401 of the education law, the opening para- graph of paragraph (b) of subdivision 2 as amended by chapter 717 of the laws of 1981 and subdivision 3 as amended by chapter 507 of the laws of 2008 are amended and a new subdivision 6 is added

* Section 2: Paragraphs (a) and (b) of subdivision 3 of section 6401-a of the education law as added by section 1 of part E-4 chapter 57 of the laws of 2007.

* Section 3: Paragraph (a) of subdivision 1 and subdivision 2 of section 6402 of the education law, paragraph (a) of subdivision 1 as amended by chapter 439 of the laws of 1988 are amended.

* Section 4: Section 6403 of the education law is REPEALED

* Section 5: Severability clause: Hereby declared to be the intent of the legislature that this act would have been enacted even if such invalid provisions had not be included herein.

* Section 6: The act shall take effect immediately_

Justification

This Bill aims to reform the Bundy Aid which itself provides unrestricted financial support to certain independent postse- condary institutions located in the New York State. Introducing this bill will ensure that necessary reforms will be made to Bundy Aid. These reforms will ensure that state aid will be distributed to students who are New York State residents only and not to students who are from neighboring states. This in turn will ensure that tax payer's money shall be kept for students of the state, thus providing better financial efficiency for the people of New York.
