BILL NUMBER:A10792
Title of bill
An act to amend the military law, in relation to the appointment of the commander of the New York air national guard
Purpose of the bill: This bill would broaden the eligibility criteria for appointment as commander of the, New York Air National Guard.
Summary of provisions:
Section 1 of the bill would delete the words "as a pilot of services types of aircraft" from subdivision 3 of section 40 of the Military Law.
Section 2 of the bill would provide an immediate effective date.
Existing law: Military Law § 40(3) states that the New York Air National Guard shall be commanded by a general officer who shall be federally recognized or qualified for federal recognition in a grade not below that of brigadier general, and who has received an aeronautical rating as a pilot of service types of aircraft.
Legislative history: This is a new bill.
Statement in support: This legislation would, delete the requirement that the commander of the New York Air National Guard be a pilot of service types of aircraft (e.g., fixed-wing aircraft or helicopters) flown by the Air National Guard and would broaden eligibility for appointment as commander to include navigators and air battle managers. This would give the Governor more leeway in making an appointment and a larger pool of qualified, aeronautically rated officers from which to select.
Budget implications: None.
Effective date: This bill would take effect immediately.
