BILL NUMBER:A10799

Title of bill

An act to legalize, validate, ratify and confirm certain transportation contracts of the New Hyde Park-Garden City Park union free school district

Purpose or general idea of bill

bill would legalize certain transporta- tion contracts from the 2008-2009 school year between the New Hyde Park- Garden City Park Union Free School District and Huntington Coach.

Summary of specific provisions

Section one of the bill legalizes, validates, ratifies and confirms all acts done by the New Hyde Park-Gar- den City Park union free school district and by all officers, employees or agents of such school district relating to or in connection with a transportation contract for the 2008-2009 school year, in the amount of $47,160 with Huntington Coach.

Section two of the bill directs the education department to consider the costs of the aforementioned contract set forth in section one of this act as valid.

Justification

There was a situation in the New Hyde Park-Garden City Park Union Free School District during the 2008-2009 school year which proved to be problematic. The district began the school year short two bus drivers, which for most districts might not affect the transporta- tion department drastically, however this district only has 3 in-house drivers when fully staffed. The district was supposed to start the year fully staffed but the finger-printing clearance from the state was taking longer than anticipated. The district's Director of Transporta- tion, after getting a multiple quotes, hired Huntington Coach and went forward with an emergency contract (allowable by the state for 30 days).

Due to the state's continued delays in the finger-printing process, the contract with Huntington Coach had to be continued for most of the year. The continuation of this contract, for reasons out of the district's control, cost the district and local tax payers 547,160. This legis- lation would forgive the district of this unanticipated and unfair cost placed on them by the state's slow turnaround time.
