BILL NUMBER:A10805

Title of bill

An act to amend the executive law and the general busi- ness law, in relation to creating a consumer bill of rights regarding railroad passengers

Purpose

Creates a consumer bill of rights regarding railroad passen- gers and an Office of the Railroad Consumer Advocate with the NYS Consumer Protection Board.

Summary of provisions

Section 1. Paragraphs C and D of subdivision 2 of section 553 of the executive law, paragraph C and amended and para- graph D as added by chapter 472 of the laws of 2007, are amended and a new paragraph E is added.

Section 2. The general business law is amended by adding a new Article 14-B.

Section 251-n: Definitions.

Section 251-o: Consumer bill of rights regarding railroad passengers.

Section 251-p creates the Office of the Railroad Consumer Advocate with- in the NYS Consumer Protection Board.

Section 251-q: Limitations on applicability of this article.

Section 251-r: Severability.

Section 3. Effective Date.

Justification

In December 2009, 150 passengers were stranded on the Long Island Rail Road for more numerous hours. The LIRR failed to provide its consumers with appropriate information in regards to its operations. New York State needs to take the lead in adopting measures that protect consumers and help prevent outrageous incidents like this from occurring in the future. Mandating railroads regulated by the Metropolitan Transportation Authority provide their riders with fresh air, lighting, waste removal services, and adequate food and drinking water when facing significant delays is not only humane but also not overly burdensome to the railroads.

Legislative history

None.

Fiscal implications

To be determined.

Effective date

This act shall take effect on the first of January next succeeding the date on which it shall have become law.
