BILL NUMBER:A10822

Title of bill

An act to amend the penal law, in relation to the misuse of solvents or formaldehyde based fluids

Purpose or general idea of bill

Prohibits misuse of solvents or formal- dehyde based fluids in conjunction with narcotics

Summary of specific provisions

Section 1. Subdivision 1 of section 220.50 of the penal law, as amended by chapter 627 of the laws of 1990, is amended to read as follows:

1. Diluents, dilutants or, adulterants, or solvents, including but not limited to, any of the following: quinine hydrochloride, manitol, marmite, lactose or, dextrose, or a formaldehyde based fluid.

Justification

This legislation is being introduced to thwart a growing problem in our community. Recently, Syracuse Police reported seeing an increase in demand for a drug called, Water or Smoking Water. Smoking Water is the process of dipping a tobacco or marijuana cigarette into embalming fluid, spiked with PCP (Angel Dust). This toxic combination produces a violent and psychotic effect on its user.

This bill will add legal consequences for anyone who is caught with this type of material. Better regulation and education is needed for this increasing problem,
