BILL NUMBER:A10831

Title of bill

CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY propos- ing amendments to section 3 of article 7 of the constitution, in relation to implementing the budget of the previous fiscal year where a current fiscal year's budget is not enacted in a timely manner

Purpose or general idea

Provides for adoption of previous year's budg- et in certain cases.

Summary of specific provisions

If the budget has not been enacted by the legislature and approved by the governor on or before April first in the year submitted, then the budget which was enacted into law for the preceding fiscal year shall be enacted for the current fiscal year and shall remain in effect unless and until a budget shall be enacted far the current fiscal year.

Justification

For 20 of the past 22 years, the state's budget has been late. As a result, the government and legislature have rushed to pass emergency appropriations to cover this short term emergency. By enacting the previous year's budget, state workers and vendors who deal with the state would not be adversely affected by the failure of the government and legislature to pass a budget.
