BILL NUMBER:A10892
Title of bill
An act to amend the general business law, in relation to motor vehicles equipped with factory installed global positioning systems
Purpose or general idea of bill
Relates to clearing data in motor vehi- cles equipped with factory installed global positioning systems.
Summary of specific provisions
Section 198-b of the general business law is amended by adding a new subdivision h which pertains to motor vehicles equipped with factory installed global positioning systems. This bill creates the duty of the dealer of any used motor vehicle fitted with factory installed global positioning equipment to have any addresses and other data cleared from such global positioning equipment prior to delivery of such motor vehicle to a new owner. Failure to comply shall be punishable by a civil penalty not to exceed one hundred dollars.
Justification
This is a common sense approach to afford the previous owner of a motor vehicle the peace of mind to ensure their private information is not readily available to the subsequent owner of their previously owned vehicle. When you purchase a used motor vehicle from a dealer you are not allowed to know the previous owners name; in the same instance you should not be allowed to have their address and other trip data from the global positioning equipment.
