BILL NUMBER:A10896
Title of bill
An act to amend the public service law, in relation to the inspection and examination of apparatus by the agent of a utility or municipality and to repeal section 47 of such law relating thereto
Purpose or general idea of the bill
The agent of a utility company or municipality may not enter the premises to inspect apparatus, regardless of whether the premises are locked or unlocked, without the permission of a person lawfully in control of the premises, nor use any force to carry out the inspection and examination.
Summary of specific provisions
The agent of the utility company or municipality shall exhibit a photo identification badge and a written authority signed by the president or vice president and secretary or assistant secretary of the corporation, or by the mayor or clerk of a municipal corporation or by the chairperson and secretary of a municipal board in control of a municipal utility.
Any inspection or examination will be conducted on a non-holiday work day between 8 am and 6 pm or a reasonable time requested by the custom- er, except when an emergency may threaten the health or safety of a person, the surrounding area or the municipality's or utility's distrib- ution system or when the commission by regulation establishes a differ- ent time for the inspection and examination where there is evidence of meter tampering or theft of service.
Justification
Recently there have been cases where the agent for the utility company or municipality has entered the premises when the owner has not been home, creating both a liability, safety, as well as a secu- rity issue.
