BILL NUMBER:A11058
Title of bill
An act to amend the public authorities law, in relation to contracts entered into by the metropolitan transportation authority
Purpose or general idea of bill
The purpose of this bill is to limit rail facility leases to a maximum of twenty years and to prevent lessees who have violated the terms of their permit more than three times from renewing their permit.
Summary of specific provisions
This legislation adds two new subpara- graphs (1) and (ii) to section 1. Paragraph (a) of subdivision 6 of section 1265 of the public authorities law.
Justification
With the increased reliance on rail to transport munici- pal waste, particularly in New York City, constituents have raised concerns regarding limited accountability for rail roads. Their concerns are primarily related to quality of life issues (odors associ- ated with municipal waste.) Unwashed garbage transport rail cars and improperly sealed containers have dramatic impacts on the quality of life and the property values of citizens living near rail operations which carry municipal solid waste.
By stiffening the penalties for violating section 27-0305 of the envi- ronmental conservation law, this legislation encourages the rail facili- ty's management to heed New York State Law. Think of this legislation as a "Three Strikes" bill, which has been designed to underscore the value of corporate responsibility while allowing the rail facility operators reasonable leeway.
