BILL NUMBER:A11105
Title of bill
An act to amend the education law and chapter 121 of the laws of 1996, relating to authorizing the Roosevelt union free school district to finance deficits by the issuance of serial bonds, in relation to school aid payment schedules; and to amend part A of chapter 57 of the laws of 2009 amending the education law and other provisions of law relating to aid for education, in relation to the effectiveness thereof
Purpose: Effective immediately, this bill would amend Education Law so that various payments of School Aid scheduled for the month of June 2010 would be paid on or before June 30th rather than the current payment dates. The provisions would also authorize school districts to be paid on a prorated basis if the full amount needed for the payment is not available from existing appropriations.
Summary of Provisions: Section one of this bill would amend section 3609-a of Education Law to change the June 2010 general aid School Aid payment date from June 1, 2010 to June 30, 2010.
Sections two and three of this bill would amend section 3609-b of the Education Law to change the June 2010 excess cost aid payment date from June 15, 2010 to June 30, 2010.
Section four of this bill would amend section 3609-d of the Education Law to change the June 2010 BOCES Aid payment date from June 1, 2010 to June 30, 2010.
Section five of this bill would amend Chapter 121 of the Laws of 1996 to change the June 2010 Roosevelt School District advance payment date from June 1, 2010 to June 30, 2010.
Section six of this bill would repeal the sunset date of the provision in the 2009-10 Enacted Budget that allows SED to pay for liabilities heretofore and hereinafter accrued.
Section seven provides that the bill shall take effect immediately, provided however that section six of this bill shall be deemed to have been in effect on and after April 1, 2010.
Statement in Support and Budgetary Implications: This bill is necessary to ensure that the State can meet its fiscal obligations in the month of June. The Division of the Budget currently projects that in the early part of June the State faces a severe shortage of cash, but the funds are expected to be available
by the end of the month to make these remaining 2009-10 School Year payments by June 30th -- the last day of the school year.
