BILL NUMBER:A11114

Section 1 of the bill amends Section 91 10 of the Insurance Law to require that one-half percent of the moneys collected pursuant to the motor vehicle law enforcement fee be paid to the newly created Innocent Uncompensated Motorist Accident Fund.
Section 2 of the bill amends the State Finance Law to create the Inno- cent Uncompensated Motorist Accident Fund and specifies that the moneys deposited into the Fund are for the purpose of compensating motor vehi- cle owners who are involved in accidents caused by persons, teams, motor vehicles, and other equipment engaged in work on a highway.

Justification
Every year New York drivers are involved in accidents involving vehicles legitimately engaged in work on a highway such as snow plowing, construction, and road repair. Some of these motorists may not be carrying collision insurance on their vehicles. Consequently, when they get into an accident caused by a snow plow or other hazard vehicle they may suffer a total loss of their vehicle and receive no compensation for damages. This despite the fact that they are not at fault in any but rather just in the wrong place at the wrong time. This legislation is intended to remedy these instances of pecuniary loss by diverting a minute portion of the 510 motor vehicle law enforcement fee that every insured vehicle owner pays to compensate the owners of vehi- cle involved in such accidents.
