BILL NUMBER:A11135

Title of bill

An act to amend the vehicle and traffic law, in relation to imposing a cap on mandatory surcharges for certain infractions of the vehicle and traffic law

Purpose of the bill

The bill will limit mandatory surcharges for certain traffic infractions to 50% of the statutory fine or the mandato- ry surcharge, Which ever is less.

Summary of provisions

Section one, two and three of the bill amends subdivision one of section 1809 of the vehicle and traffic law that places a cap on mandatory surcharges for certain traffic infractions.

Section four and five of the bill amends subdivision one of section 1809-e of the vehicle and traffic law that places a cap on mandatory surcharges for certain traffic infractions.

These surcharge caps do not apply for convictions of misdemeanors, felo- nies or any DWI crimes.

Justification

Mandatory surcharges for traffic infractions are a fixed cost without regards to the amount of the fine. Some people end of paying excessive surcharges that are 4 or 5 times the amount of the fine. This bill limits the amount that a person can pay in surcharges to half the statutory fine or the current surcharge, whichever is less. For example, this will prevent a person from paying an $80 surcharge for a $25 fine.
