BILL NUMBER:A11152
Title of bill
An act to amend the workers' compensation law, in relation to the establishment of rates of payment and delivery of health care services
Purpose
Require the Worker's Compensation board to promulgate an annual schedule of medical-related fees.
Summary of provisions
Section 1: amends section 13 of the workers' compensation law, as amended by chapter 6 of the laws of 2007 in relation to annual schedules of charges and fees for medical treatment and care.
Section 2. A revision to the schedules existing as of the effective date of this act shall be published by the chair on behalf of the workers' compensation board no later than thirty days following the effective date of this act.
Section 3. This act shall take effect immediately.
Justification
This legislation will require the WCB to promulgate an annual schedule of medical-related fees for services provided in the workers compensation system. Presently, the Board is required to prepare such a schedule but no statutory obligation on the frequency of its review exists. The current schedule has not been revised since 1996., Through enactment of this bill, an annual requirement would be imposed upon the board to review and to publish a schedule following such review, even when no changes are made in that schedule. The process would demonstrate however that the Board has determined that employers and insurers are neither overpaying nor underpaying for services provided."
