BILL NUMBER:A11163

Title of bill

An act to amend the executive law, the village law, the town law and the not-for-profit corporation law, in relation to searches for sexually violent offense convictions for firefighters

Purpose or general idea of bill

This bill will allow fire officials to search for violent sex offense convictions when processing applications for membership to a fire company.

Summary of specific provisions

Amends the section heading and subdivision 1 of section 837-0 of the executive law, as added by chapter 423 of the laws of 1999; paragraphs (a), (b), and (c) of subdivision 3 of section 837-0 of the executive law, paragraphs (a) and (c) as added by chapter 423 of the laws of 1999 and paragraph (b) as amended by chapter 689 of the laws of 2002; subdivision 18 of section 10-1006 of the village law, as added by chapter 719 of the laws of 1985; subdivision 19 of section 10-1006 of the village law, as added by chapter 423 of the laws of 1999; section 176-b of the town law is amended by adding a new subdivision 18; paragraph (c) of section 1402 of the not for profit corporation law is amended by adding a new subparagraph 6.

Justification

Firefighters hold a unique place of trust in our communities. The requirement for notification of child abuse and the use of fire departments as safe havens for unwanted babies both are indicators of this role. Many, if not most, fire departments are unable to properly screen applicants due to the current statutes outlining the membership applicant process. Adding those convicted of violent sex crimes at the highest levels should be excluded from joining or maintaining membership in volunteer fire departments.
