BILL NUMBER:A2882B
Title of bill
An act to amend the executive law, in relation to the compilation of firearm and ballistic data
Purpose or general idea of bill
This bill will require that any expended projectile, expended shell casing or gun seized, found or otherwise coming into possession of any state or local law enforcement agency, which is believed to have been used in the commission of a violent felony offense, as defined in subdivision one of section 7002 of the penal law, be submitted to the division of state police, which shall cause to be entered in the automated electronic databank (established pursuant to subdivision six of section 369-ff of the general business law) pertinent data and other ballistic information relevant to iden- tification of the expended projectile, expended shell casing or gun.
Summary of specific provisions
Section 1 of this bill amends subdivi- sion 4 of Section 230 of the executive law by adding paragraphs (b) and (c). Paragraph (b) sets forth the submission requirements being placed on state and local law enforcement agencies of the division of the State Police. Paragraph (c) requires that materials submitted must be done so in thirty days of coming into the possession of a state or local law enforcement agency. Section 2 sets forth the effective date for this bill.
Justification
Currently, local law enforcement agencies are not required to submit evidence to a centralized crime laboratory. Requiring agencies to do so would facilitate the exchange of information, increas- ing the effectiveness of both the labs and the local law enforcement agencies. Requiring submission of certain materials to a crime laborato- ry and entry into a computerized ballistic system will allow these mate- rials to be cross-checked with previously entered materials.

Fiscal implications
Due to the increased workload for crime laborato- ries resulting from this bill it will be necessary to provide additional funding to hire staff needed to implement the requirement of this legis- lation. At this time the amount of funding necessary is unknown.
Effective date
120 days after this bill is signed it shall become law.
