BILL NUMBER:A3282A

Title of bill

An act to amend the alcoholic beverage control law, in relation to the time and form for the furnishing of certain information to municipalities and community boards by applicants for certain original, renewal, or alteration alcoholic beverage licenses and the applicability of certain public notice requirements

Purpose or general idea of bill

The bill would require that any appli- cant for a license, renewal or alteration of an alcoholic beverage license, notify the local municipality or community board not less than 60 days prior to the submission of the application.

Summary of specific provisions

The bill amends the alcoholic beverage control law by adding a new subdivision 1-a to section 54, adding a new subdivision 1-a to section 54-a, amending subdivision 2-a of section 55, adding a new subdivision 2-a to section 63, amending subdivision 2-a of section 64, adding a new subdivision 2-a to section 64-a, adding a new subdivision 2-a to section 64-b, amending subdivision 3 of section 64-c, amending subdivision 3 of section 64-d, amending subdivision 1-a of section 81, adding a new subdivision 1-a to section 81-a, amending subdivision 7 of section 100 and amending subdivision i of section 110-a to require applicants for a license or renewal of a liquor license to notify the appropriate entity at least 60 days prior to the submission of the application.

Justification

Many localities, and community boards have found that the current 30 days required for notification is not sufficient time to review the application since many of these boards only meet once a month. This bill will require the applicant to submit these notifica- tions at least 60 days in advance to allow the localities and community boards time to review the application. In addition, the community has no input in the granting of licenses for establishments that sell liquor for off-premise consumption. With many communities seeing an increase in complaints regarding the sale of beer and liquor to minors at grocery and liquor stores it is equally as important for communities to have an opinion in the granting of off- premise licenses. This bill will correct that oversight.
