BILL NUMBER:A4168A

Title of bill

An act to amend the executive law, in relation to minority and women-owned business enterprises

Purpose

To extend to improve the law to help minority-and women-owned business enterprises continue to develop as they have done over the last fifteen years when this law was put in place. The original goals have not yet been met, but with the new amendments to the executive law the remaining goals laid out in 1988, which have not yet. been achieved, can be reached.

Summary of provisions

Amends Executive Law § 311 by adding to the educational programs a specific request for a mentorship program.

Section 311 would be further amended to include a requirement for a registry of certified minority and women-owned business enterprises to more effectively contact these businesses with contract and subcontract opportunities.

Amends § 313 by encouraging true joint ventures among prime contractors and minority-and women-owned business enterprises.

Amends section 313 by prohibiting the use of automatic waivers.

Amends § 314 by requiring re-certification of all certified minority and women-owned business enterprises:

Justification

Minority and women-owned business enterprises need assistance from the state to move them into a competitive position with non-minority and women-owned business enterprises. The original goals of this part of the executive bill was to create and promote equality by helping advance minority and women-owned business enterprises to a level on par with other business enterprises.

This bill is necessary to rectify past injustices that have burdened the advancement toward true equality among business enterprises owned by women and minorities throughout our state and our nation. New York has been a leader in remedying past injustices and can continue to do so through this bill.
