BILL NUMBER:A421

Title of bill

An act to amend the county law, in relation to assistant district attorneys

Purpose or general idea of bill

To remove the distinction currently existing in New York City between Assistant District Attorneys who work in the New York County District Attorney's office and those who work for the other four County District Attorneys of New York City, by permitting any duly appointed Assistant District Attorney in New York City to reside in any county other than the one in which he is employed.

Justification

Presently, in New York City, Assistant District Attorneys who work in the office of the New York County District Attorney may reside outside the City of New York. However, District Attorneys who work for the other four County District Attorneys, must reside in New York City. There is no justification for such a distinction, which is unfair and inequitable. Moreover, this condition greatly restricts the ability of four of the five District Attorney offices in New York City to recruit and hire the best attorneys possible since so many young attorneys live outside the City of New York. In recent years, the County District Attorney's offices have grown dramatically in terms of manpower and personal demands because of the increasing number of case loads, motions and pretrial hearings confront- ing these offices. In order to meet these demands, it is necessary to hire additional Assistant District Attorneys-the present confinement causes great difficulty and restrains the recruitment of truly qualified attorneys. This bill will ease this confinement by releasing residency restriction.
