BILL NUMBER:A422

Title of bill

An act to amend the vehicle and traffic law, in relation to weight restriction violation in cities not wholly contained within one county

Purpose or general idea of bill

This legislation amends the distinction in penalties for overweight multi-axle vehicles between upstate counties and counties within New York City.

Summary of specific provisions

This bill amends paragraphs (b), (c) and (d) of subdivision 19 of section 385 of the vehicle and traffic law concerning fine schedules.

Justification

This legislation provides a more equal standard of fines for vehicles which exceed multi-axle vehicle weight restrictions so that a fairer fine schedule will apply for the entire State of New York. While the proposed changes provide greater tolerance in New York City it concurrently doubles the fines for second and subsequent violations thereby providing a deterrent effect.
