BILL NUMBER:A423

Title of bill

An act to amend the penal law, in relation to crimes committed with the use of a firearm; to amend the general business law, the penal law, and the vehicle and traffic law, in relation to making technical corrections thereto; and to repeal section 265.08 of the penal law relating to crimes committed with the use of a firearm

Purpose or general idea of bill

Provides for mandatory five year period of imprisonment for persons convicted of committing any crime with the use of a firearm. SUMMARY OF SPECIFIC PROVISIONS: JUSTIFICATION: Too many crimes are committed with the aid of a gun and the perpetrator suffers no serious consequences. The only way to prevent a criminal from using a gun in a commission of a crime is to have a law which calls for a mandatory 5 year prison term without parole. If this bill is enacted, eventually criminals will get the message and realize that they cannot arbitrarily endanger peoples lives.
