BILL NUMBER:A4296C
Title of bill
An act to amend the public authorities law, in relation to confidentiality agreements
Purpose or general idea of the bill
To ban the use of employee confi- dentiality agreements for public authorities, except where information is protected by FOIL.
Summary of specific provisions
Adds new section 2853 to the Public Authorities Law. Bars the use of confidentiality agreements between state and local authorities and their employees. Exceptions are made for information that is already protected by current state law. In the event there is a conflict over whether information is protected or not this bill directs authorities to establish a process for determining this.
Justification
New York's Public Authorities have a long history of operating without proper public scrutiny. The state has acted in recent years to reform these entities. This bill continues that trend and protects employees of public authorities.
