BILL NUMBER:A440
Title of bill
An act to amend the labor law, in relation to non-recov- erable benefits
Purpose or general idea of bill
This bill is to clarify the term bene- fit allowed for purposes of this subdivision.
Summary of specific provisions
Clarifies that allowed benefits shall include benefits that are non-re- coverable pursuant to subdivision four of section five hundred ninety- seven of the unemployment law.
Justification
The current law makes it difficult for a unemployment insurance benefit claimant to obtain an attorney for representation, even if they have a meritorious case, in situations where the only remaining issue in the case is that of recoverability. This legislation would allow attorneys to receive a fee as approved by an administrative law judge where the claimant prevails on the issue of recoverability.
