BILL NUMBER:A600B

Title of bill

An act to amend the agriculture and markets law, in relation to the release of animals to a pound, duly incorporated society for the prevention of cruelty to animals, duly incorporated humane society or duly incorporated animal protective association in certain cases

Purpose or general idea of bill

To allow the release of animals to other entities in addition to adoptees or owners to increase chances for adoption.

Summary of specific provisions

This bill amends subdivision 2-e and paragraph b of subdivision 5 of section 374 and subdivision 7-a of section 118 of the agriculture and markets law to provide that a pound, shelter, society for the prevention of cruelty of animals, humane society, dog protective association, dog control officer, peace officer or any agent thereof may release an animal to another pound, shelter, society for the prevention of cruelty of animals, duly incorporated humane society or duly incorporated animal protective association if such action is reasonably likely to create an opportunity for the adoption of such animal within a reasonable period of time.

Effects of present law which this bill would alter

Under existing law, shelters may only release an animal for adoption or redemption by the animal's owner. It does not allow a shelter to transfer animals to any of the above-named entities/persons, although such authorization would considerably enhance an animal's chance for adoption.

Justification

This legislation will ensure that whenever there are areas of the state which experience increased demand for animals and the supply of such animals is readily abundant in other areas of the state, other animal shelter-type entities may transport such animals to another shelter and release the animals to that shelter for the purpose of facilitating adoption.
