BILL NUMBER:A6153A
Title of bill
An act allowing Matthew A. Miraglia, employed by the village of Scarsdale, to enroll in a twenty year retirement plan
Provisions
Section 1 allows Matthew A. Miraglia, a police officer in the Village of Scarsdale and member of the New York State and Local Police and Fire Retirement System, to apply for participation in the twenty year retirement plan by filing the appropriate application with the state comptroller before June 30, 2010. This section allows the Village of Scarsdale to elect to allow such participation by filing with the state comptroller before December 31, 2009 a resolution of its governing body certifying that said officer is eligible to apply as of that date.
Section 2 provides that the cost of his election to the twenty year retirement plan shall be borne by the Village of Scarsdale.
Section 3 provides the effective date.
A fiscal note is provided.
Justification
Matthew A. Miraglia was eligible to enroll in the twenty year retirement plan, pursuant to Section 384-d of the Retirement and Social Security Law. For reasons other than his own negligence, Mr. Miraglia failed to apply in a timely manner for participation in the plan. This bill would allow Mr. Miraglia to apply for enrollment in the twenty year retirement plan, which he would have done had he been given the opportunity at the appropriate time.
This is a local bill that has been requested by the Village of Scarsdale.
Fiscal impact
Local Fiscal Impact: Estimated increase of approximately $4,500 in the annual contributions of the Village of Scarsdale for the fiscal year ending March 31, 2010. In addition, based on the assumption that payment will be made on February 1, 2010, the Village will bear a one time payment of $74,500 for immediate past service costs.
Fiscal impact to state
None.
Effective date
This act shall take effect immediately.
