BILL NUMBER:A6192 REPLACEMENT 5/21/10
Title of bill
An act to amend the New York city civil court act, in relation to the appointment of members of the advisory council for the housing part
Summary of provisions
OF BILL: Section 1 of the bill would amend subdivision (g) of Section 110 of the New York City Civil Court Act to provide for the addition of one tenant member to the advisory council and for the addition of the chair of the New York City Housing Authority as an additional real estate member on the council. The two new members added by this bill would replace two of the four public at large members of the advisory council, thus maintaining the advisory committee at fourteen members.
Section 2 provides that the bill is effective January 1, 2011.
Justification
Under section 110 (g) of the New York City Civil Court Act, the Administrative Judge selects housing judges from a list of persons found qualified by the advisory council. The selection of housing court judges is subject to the approval of the Appellate Divisions of the First and Second Judicial Departments. The advisory council currently consists of two members each of the following groups: real estate industry, tenants' organizations, civic groups and bar associations. In addition the advisory council contains four members of the public at large, a representative of the Mayor (HPD) and a representative of the Commissioner of Housing and Community Renewal (HCR). The public interest in the administration of justice is best served where the advisory council represents the major participants in the process.
An additional tenant representative will add needed balance to the advisory council. The NYCHA member is important because NYCHA provides housing for over 600,000 residents in the five boroughs.
