BILL NUMBER:A6838A

Title of bill

An act to amend the judiciary law, in relation to the appointment of grand jury stenographers by the district attorney of the county of Jefferson

Purpose or general idea of the bill

Authorizes Jefferson county district attorney to appoint grand jury stenographers residing in the county of St. Lawrence or in any county in the fifth judicial district.

Summary of specific provisions

Section 322 of the judiciary law is amended to allow the Jefferson County District Attorney to appoint a grand jury stenographer from St. Lawrence county or from any county in the fifth judicial district.

Justification

Current law requires that stenographers for the grand jury be appointed from the county in which they reside. Due to the lack of reliable availability of resident stenographers in Jefferson county, the system would be better served if the local district attorney were authorized to appoint stenographers who reside in St. Lawrence county or in the judicial district than being confined to county borders.
