BILL NUMBER:A6935A

Title of bill

An act to amend the general municipal law, in relation to alternative energy management planning

Purpose

Requires municipalities to consider using alternative energy sources in the construction of new municipal buildings.

Summary of provisions

The general municipal law is amended by adding a new section 120-dd to state:

1. Pursuant to the authority of this section, no later than September 1, 200B, a municipality shall adopt a local law to require that alternative energy sources be used to provide energy to any municipal building when- ever it is found to be cost effective.

2. Prior to the enactment of such a local law, the municipality shall hold at least one public hearing relating to the proposed provisions and shall give due consideration to existing energy conservation and alter- native energy sources, standards, technologies or techniques, the avail- ability and reliability of energy conservation and alternative energy sources and any additional effort and expense to be incurred in meeting the proposed requirements.

3. Municipalities may request a state or federal agency, authority or commission for assistance providing information concerning alternative energy sources.

4. Municipalities are authorized to form alternative energy planning units for the purpose of jointly entering into energy performance contracts as defined by article 9 of the energy law for the provision of alternative energy services.

5. For the purpose of this section, the following words and phrases will be defined: (a) "building" (b) "alternative energy sources" and (c) "planning unit".

Justification

This bill promotes forms of alternative energy which is reasonably priced: reliably available and non-pollutant. This bill seeks to promote conversion to Alternative Energy source by providing private industry with 'a market share when private industry is able to meet the three criteria of price, availability and non-pollutant.
