BILL NUMBER:A7514A
Title of bill
An act in relation to allowing town justice James Dwyer to temporarily reside outside of the town of Marcellus
Purpose
Allows Town Justice James Dwyer to temporarily reside outside the town of Marcellus in an adjoining town.
Summary of provisions
Amends Section 3 of the public officers law, to allow Town Justice James Dwyer to temporarily reside outside the town of Marcellus in an adjoining town until such time that his term expires on December 31, 2011.
Justification
The Town of Marcellus has requested that the New York State Legislature introduce and pass legislation that would allow Town Justice James Dwyer to temporarily live outside the Town of Marcellus until his term expires on December 31, 2011. Justice Dwyer has served the Marcellus community for 26 years. However, due to a family medical issue, Justice Dwyer recently sold his home and will temporarily be residing with his wife in an assisted living facility in the Town of Skaneateles, which is adjacent to the Town of Marcellus. No such facili- ty exists in the Town of Marcellus. Consequently, Town Justice Dwyer will no longer be eligible to service as town justice since the Public Officers Law requires that any individual serving in a town office must be an elector of the town. It is requested by the Town of Marcellus that Justice Dwyer be allowed to complete his term as town justice.
