BILL NUMBER:A7765A

Title of bill

An act to amend the education law, in relation to disre- garding certain payments required to be made by a board of cooperative educational services from the calculation of total spending for the purposes of adopting contingency budgets

Purpose or general idea of bill

To permit school districts that will be operating on a contingency budget for the 2009-2010 school year and thereafter to exclude the amount of increased expenditures for BOCES capital projects from the statutory cap on contingency budgets. Such increases will be treated similar to other capital expenses which are currently excluded from the cap pursuant to current law.

Summary of specific provisions

Existing law provides that a contingency budget for a school district shall not increase by more than 120% of the Consumer Price Index or 4%, whichever is less, over the prior school year. Section 2023 currently provides for the exclusion of capital expenditures resulting from the construction, acquisition, recon- struction, rehabilitation or improvement of school facilities, including debt service and lease expenditures, subject to the approval of the qualified voters where required by law.

Justification

When the contingency budget statute was originally enacted the intent was always to exclude capital and debt service costs from the contingency budget calculation. This bill would allow for BOCES capital expenses to similarly be excluded from the statutory cap on contingency budgets.
