BILL NUMBER:A7989A

Title of bill

An act to authorize the Brocton central school district to repay over a period of six years certain overpayments of state aid

Purpose or general idea of bill

The purpose of this legislation is to adjust certain state aid payments to the Brocton Central School District so that an $810,893 state aid overpayment may be deducted from future state aid payments made to such school district.

Summary of specific provisions

This bill allows for deductions from state aid payments due to the school in the years 2009 until 2014. Each deduction shall be to the sum of one-sixth the total of the excess payment ($810,893). There shall be no interest penalty assessed against the district or collected by the state.

Justification

Requiring the Brocton school district to make payment directly back to the State in one collective sum would place extreme fiscal strain upon the district. By allowing repayment from the school's future state aid payment over the next six years, the school will be able to shoulder this financial burden in a more appropriate manner and, thereby, allowing the school to maintain its standards of educational quality.

Prior legislative history

This is new legislation.

Fiscal implications

Sate Aid in the amount of $810,893 is to be repaid to the state by deductions made from future state aid payments to the school district.

Effective date

This act shall take effect immediately.
