BILL NUMBER:A8043
Title of bill
An act to amend the civil practice law and rules and the public officers law, in relation to fees allowed to be charged for certain advertising
Purpose or general idea of bill
The purpose of this legislation is to provide equity in the fees charged for certain public advertising between the New York City and metropolitan daily newspapers.
Summary of specific provisions
Section one amends §8007 of the Civil Practice Law and Rules to include newspapers principally printed, circu- lated, or having its principal office in Richmond County within the language exempting newspapers published in the City of New York and various other counties in the state from the statutory race set forth in the section. Section 2 amends §70-a of the Public Officers Law to include newspapers principally printed, circulated, or having its prin- cipal office in Richmond County within the language exempting newspapers published in the City of New York and various other counties in the state from the statutory rate set forth in the section.
Justification
Newspapers published in all of the counties in the New York Metropolitan area (the "Area") other than Richmond County have been exempted from the statutory fee set forth in the two sections of the law involved. The exemptions were granted because of the high costs of labor, goods and services in the Area. Newspapers in Richmond County face the same high costs as the other newspapers in the Area. Moreover, these costs have dramatically increased since the law was last amended to add Nassau County as exempted. It is now difficult, if not impossi- ble, to cover the expense of publishing the notices that are required to be published in a newspaper by law or order of a court by charging the statutory fee. This bill would help ensure the continued publication of these types of notices to the citizens of Richmond County who rely on newspapers published in that county.
