BILL NUMBER:A8327
Title of bill
An act to amend chapter 292 of the laws of 2007 amending the state finance law relating to state contracts with not-for-profit organiza- tions, in relation to making permanent the effectiveness of such provisions
Purpose
The purpose of this bill is to renew expiring provisions of the 2007 law regarding non-for-profit contracts. The provisions of this bill allow- ing the comptroller to waive interest and penalties in unusual circum- stances are set to expire. This bill will make these provisions perma- nent.
Summary of provisions
Section 1 amends § 8 of chapter 282 of the laws of 2007 to make perma- nent changes allowing the comptroller to waive interest and penalties in unusual circumstances.
Justification
Not-for-profit organizations have been finding themselves having to scramble to recover from late notification by agencies of intent not to renew contracts. When the notification does come, the NFP frequently is in the position of having made expenditures in anticipation of contract renewal. Also, NFPs have been placed in positions of being required to waive their statutory right to interest payment from the agency in order to execute the contract. In 2007, changes were made to make these proce- dures more effective. This bill makes permanent the provisions allowing the comptroller oversight of determining when there are unusual circum- stances allowing the state to waive interest and penalties for having renewed the contract late.
